It was so unprecedented and so big—the government could not ignore the voices of women.” There has been so much technological advancement, but no advancement on the rights of women,” a protester said later. ” “The largest message we wanted to express was that the government was not treating women as people. They are inexpensive and can operate for extended periods on a battery and have also been used to covertly film sexual conduct which has then been posted without consent from a participant. The government in 2004 imposed a requirement that all cell phone cameras have an audible shutter noise, in response to concerns then emerging about the use of camera phones to take non-consensual images such as “upskirting.” Silent camera apps can now be used to get around this. The country lags globally and in East Asia in protecting the rights of women and girls.

This GADPH loading control antibody produced strong bands at 36kDa and I would definitely recommend using it for western blots. We were using a anti mouse-GAPDH antibody and this anti rabbit-GAPDH antibody gave us more flexibility for probing the blot. This antibody is raised against full length GAPDH of human origin. GAPDH participates in nuclear events including transcription, binding RNA, RNA transportation, DNA replication, DNA repair and apoptosis.

Without the means to leave, Hasina remained home with her six children. Nesrin, 35, said she was with her husband and five children in their family compound when six uniformed RSF fighters entered. They killed many civilians, raped women and girls, and looted families’ possessions, including tractors, carts, money, jewelry, and furniture. Another Fayu resident said she saw RSF fighters taking groups of women and girls, including Hania, away that morning.

In most states, important bodies, such as child welfare committees designed to oversee the care of vulnerable children, do not receive the funding they need. Implementation problems have also hindered other attempts to improve the protection of children. The new law also establishes guidelines for the police and courts to deal with victims sensitively and provides for the setting up of specialist child courts. For example, it was not clear whether any law covered non-penetrative sexual acts committed against boys.

Radha told Human Rights Watch that her abuser was the owner of a brick kiln factory in Uttar Pradesh, where she was forced to work as his maid for two months. They told her she should have gone to a marriage counselor rather than report the case to them and criticized her for taking the child to the private hospital. Sara also complained about the behavior of the police, who she said had initially been supportive. Sara told Human Rights Watch that hospital authorities, instead of keeping her in a separate room, made the child wait for several hours in an adult labor ward.

One group sharing these images reportedly has 220,000 members. Human Rights interview with Meena Jain, chairperson of a child welfare committee, Bengaluru, May 25, 2012. This was a British-era law that banned sodomy, defined as “carnal intercourse against the order of nature.” Lawyers and judges have since debated whether or not this definition also covers non-penetrative or oral sex. Previously, when boys were abused, prosecutors would often turn to section 377 of the Indian Penal Code. Neeraj Chauhan, “Chief warden, 2 others, held for orphanage abuse,” Times of India, February 19, 2012, “46 women achievers felicitated,” The Tribune, March 26, 2012.

The government should hold perpetrators accountable, provide comprehensive sexuality education to children and adults, and take meaningful steps to promote gender equality. Above all, we would like to express our gratitude to the survivors of child sexual abuse and their relatives who agreed to discuss their painful experiences with us. For example, the commission in 2012 led the investigation into the sexual abuse of children at several residential institutions in Haryana. The law says that if people are aware of an incident of child sexual abuse, or think that there might be risk, they must inform the police or face up to six months in prison and a fine. Judges have completely ignored the fact that the victims of sexual abuse were vulnerable and defenseless street children, who were so desperate to get a roof over their heads that they were prepared to put up with the sexual abuse.”

  • They could also deter digital sex crimes by, for example, imposing financial consequences on perpetrators.

Reports

For months the parents of missing young women and children in the nearby slum of Nithari had complained to the police that their girls and boys had disappeared and named the man responsible. The NCPCR was set up after the discovery in December 2006 of one of the grisliest crimes in Indian history, when at least 19 children and young women were apparently raped and then killed. The demand for this law became more urgent after the widely reported case involving Ruchika Girhotra, who was sexually abused in 1990 by a senior police officer when she was 14. In May 2012, in a major step forward, the India’s parliament enacted its first law outlawing child sexual abuse. In 1998 the Indian NGO Recovery and Healing from Incest (RAHI) conducted India’s first study of child sexual abuse. Among those interviewed, children living on the street, in institutions, or already working were more likely to be the victims of sexual assault than those living with their parents and attending school, but even wealthy families were affected.

Our greatest gratitude is to the survivors of digital sex crimes who shared their stories with us, in person or through the survey. The right to freedom of expression, which is protected under international human rights law, intersects with digital sex crimes in multiple ways. Companies also have international human rights responsibilities that many fail to meet with regard to digital sex crimes.

“Even if there is evidence that a perpetrator distributed illegal footage, if he forcefully denies it, he might just get probation,” a lawyer representing survivors explained. Survivors and others who spoke to Human Rights Watch said that judges often seem more sympathetic to defendants’ arguments for leniency than to survivors’ arguments about the harm they suffered. Baek Su-yeon was among over a dozen young women filmed non-consensually by a university classmate; after he was arrested, his father called victims begging them to drop the charges.

By 2017, the number of these cases had increased eleven-fold, from 585 cases to 6,615, and they constituted 20 percent of sexual violence cases. The $5 billion K-pop music industry has been criticized for promoting sexist images of women. A woman’s position in society is lower than a man’s and her reputation, which can impact her access to employment and her personal relations, depends largely on maintaining an image of “sexual purity” and being naïve and obedient to those higher in hierarchy, including men. Respondents were able to complete it anonymously and it asked questions about their experiences of digital sex crimes. The problems survivors face in the justice system are exacerbated by a lack of women police, prosecutors, and judges.

Rishi Kant, the coordinator of Shakti Vahini, an NGO, said that many district administrations prefer cases of child sexual abuse to be covered up because they are afraid of scandals being reported in the media. Many child rights experts worry that this is happening all too often, with the result that some committees do not exercise their powers to challenge officials who fail to look after children properly or are covering up abuse. They are envisaged to be powerful quasi-judicial bodies of experts that oversee the government’s welfare officers and the police, and inspect children’s residential care facilities.

He filmed me while motha fukker we were having sex,” a respondent to the Human Rights Watch survey said. Intimate partners have opportunities to capture images illegally. After she reported the case to police, a male officer interrogated Lee Ye-rin for four hours demanding to know in detail what she had been doing in her bedroom during a period that was filmed, but afterwards she struggled to find out the status of the case. Non-consensual capturing of images is deeply harmful even when the images are not shared.

Some perpetrators choose their targets randomly, and women and girls filmed in this way may never know whether their image was captured and if so what the content of the images was or who may have viewed them. This huge commitment of human resources was indicative of just how out of control the problem of people filming and trying to film intimate images of women and girls in public toilets—and other public locations—had become. A survivor saw on CCTV cameras the perpetrator, her ex-boyfriend, physically surveilling her house, including stealing her garbage, at the same time that he was engaging in online abuse against her. In these cases, the most common location where the crime occurred was the subway (55 percent of cases), followed by 11 percent of cases on the street, suggesting that most of these cases involved crimes by perpetrators who were strangers to the women they targeted. Some survivors agreed to an image of them being captured, or took images of themselves, but did not consent to the images being shared.

Ahmed is extremely worried about the impact this has all had on the child. The community shunned the child because she was a rape victim and blamed the family for making her so-called disgrace public. Ahmed took the case to the police, he says, because he was afraid other girls would be attacked if the men were not stopped. Aditi was homeless until she was rescued by an NGO working with destitute women, Shakti Shalini, which then found her a job. Deepti, now an adult, still admits to being confused about her abuse at the hands of her father because, she says, he is a “good guy.” The doctor alerted the police, and Lalman was arrested.

The vast majority of victims (72 percent) said that they did not report the matter to anyone and only 3 percent of them or their families told the police. The report uncovered some alarming statistics, though, as explained below, the report methodology was limited and the numbers should be taken more as an indication of the seriousness of the problem than a reflection of the actual incidence of abuse. In this report, the world “child” refers to anyone under the age of 18.

South Korea faces significant gaps in fulfilling its international human rights obligations with regard to digital sex crimes. When digital sex crimes involve sharing—and often monetizing—abusive images, internet platforms are directly involved. The government has pledged to update the curricula for sexuality education, including digital citizenship.

Several survivors said their first reaction on seeing an abusive image of themselves—for example sent to their phone or in the phone or storage of a perpetrator—was to delete it. Another problem is that while seeking to protect themselves, survivors may inadvertently destroy evidence. Police typically tell victims to search for evidence—usually abusive images of themselves—and often make this a pre-condition for acting. “We advised on making interrogation rooms more private and doing more to protect victims,” an expert working with police said. When Lim Ye-ji reported a digital sex crime, she said one of the officers read out an abusive message suggesting that she was selling sex five times, loudly, in front of a room full of his all-male colleagues. Lim Ye-ji became so frustrated with inaction by the cybercrime unit at her local police station that she asked the head of the unit, “Do you want to act only if I get physical damage from this?

This report was written and researched primarily by Heather Barr, interim co-director of women’s rights. While some platforms have been cooperative with content deletion requests, many requests are ignored or rejected, which runs contrary to survivors’ rights to privacy and an effective remedy. In a joint statement, the UN special rapporteurs on the promotion of freedom of expression and on violence against women underscored how online gender-based violence negatively impacts women’s right to freedom of expression. CEDAW and other treaties require South Korea to show due diligence in preventing violation of rights by private actors and to investigate and punish acts of violence. A sex crimes detective said they face great difficulty getting cooperation from platforms overseas.

Survivors’ Need for Services

The law sets forth rules that the police must follow when interviewing victims so that they are treated with sensitivity. Many believe that the government should be prepared to bring in amendments to improve the law within two or three years, once the Ministry of Women and Child Development and its civil society partners have had the time to assess its implementation. There were also contradictions over the age at which a person could legally have sex and marry. Before the Protection of Children from Sexual Offences Act was passed, different forms of abuse were inadequately covered by laws that were not designed to address them. The judges also said that since the boys had not tried to run away during the years they claimed they were being abused, this indicated it had not happened. As a result, he says, “the existing laws on residential child care institutions leave scope for considerable confusion and possible manipulation.”
